Welcome to Local Blast! These Terms and Conditions of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you," "user," or "merchant") and Local Blast LLC, a Florida limited liability company ("Local Blast," "we," "us," or "our"), concerning your access to and use of the Local Blast mobile application, website (https://www.localblastapp.com), and any other media form, media channel, mobile website, or mobile application related, linked, or otherwise connected thereto (collectively, the "Platform").
By accessing or using our Platform, you acknowledge that you have read, understood, and agree to be bound by all of these Terms. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE PLATFORM AND YOU MUST DISCONTINUE USE IMMEDIATELY.
1. DEFINITIONS
To ensure absolute clarity across our ecosystem, the following proprietary terms are defined as follows:
- "Blast" means a single geofenced, real-time distribution event initiated by a verified merchant or user, delivering notifications or messages to other users within a specified geographical radius.
- "Blast Pass" (formerly "voucher") means a unique, finite digital asset representing an exclusive merchant offer (e.g., discounts, buy-one-get-one deals, free gifts) claimed by a user via the Platform and redeemable in person at the physical business location.
- "Blast Zone" means the precise, geofenced radius surrounding a physical location (typically 2 to 5 miles, up to 10 miles for premium tiers) within which active users can receive Blasts and claim Blast Passes.
- "Blast Buddy" means our proprietary, autonomous AI-driven inventory distribution and campaign control engine that manages scarcity, scoring, scheduling, and automatic optimization of Blast campaigns.
- "Blast Coins" means the Platform’s non-monetary, gamified in-app currency earned through user engagement (claims, redemptions, referrals) and spent on social interactions, message enhancements, and Power-Ups.
- "Power-Up" means a custom enhancement purchased with Blast Coins to temporarily modify App mechanics, such as "Radius Boost" (expanding message reach) or "Double Time" (extending active durations).
- "Claim Jail" means the Platform's automated behavioral credibility filter that temporarily suspends a user's ability to claim new Blast Passes if they accumulate a pattern of high claims without physical redemptions.
- "Community Blast" means an ephemeral, user-generated message broadcast to other users within a 2-mile radius, which automatically dissolves alongside its associated group chat after a set duration.
- "Scarcity Ratio" means the live calculated ratio of available merchant digital inventory units (Blast Passes) to active user density within a target Blast Zone.
2. ELIGIBILITY AND ACCOUNT REGISTRATION
2.1 User Requirements
To create an account and use the Platform as a consumer, you must:
- Be at least eighteen (18) years of age.
- Be a legal resident of the United States.
- Possess a mobile device equipped with active, precise GPS location telemetry.
- Consent to the continuous collection and processing of your real-time geolocation data while the App is open or running in the background, solely for the purpose of identifying active Blast Zones.
2.2 Merchant Verification and Requirements
To register as a business ("Merchant" or "Provider"), you must undergo our formal quality-gating and vetting process. To join our verified merchant network, you must:
- Verify ownership of a valid, active Google Business Profile (GBP) associated with your physical brick-and-mortar establishment.
- Maintain a minimum GBP rating of 4.0 stars or higher.
- Provide a valid Employer Identification Number (EIN) and necessary corporate registration documents.
- Provide a link to a working, active, and professional business website.
- Agree to undergo periodic quality audits conducted by Local Blast LLC to ensure offer validity and local credibility. We reserve the right to suspend or remove any Merchant who fails to meet these quality metrics.
3. MERCHANT DEPOSITS, FEES, AND SUBSCRIPTION TERMS
3.1 The Founders Club Reservation Deposit
Early adopting Merchants who register as part of the "Founders 50" program must pay a fully refundable $99.00 Reservation Deposit to secure their local territory radius and lock in lifetime "Founders" pricing.
- Refundability: This deposit is fully refundable upon written request at any time prior to the official consumer launch in the Merchant’s designated zip code.
- Territory Protection: Placing this deposit secures the Merchant’s spot in the limited local launch pool (capped at 50 local businesses per launch zone) and guarantees immediate "Day 1" activation.
3.2 Subscription Pricing Tiers
Upon the official public launch of the Platform to consumers in the Merchant's territory, the Merchant's selected monthly subscription tier will activate and become billable. Our standard tiers are structured as follows:
- Silver Membership ($197/month): Provides a standard 5-mile default Blast Zone radius and manual campaign scheduling features.
- Gold Membership ($297/month): Provides up to 60 Blasts per month, a 5-mile default Blast Zone, and advanced performance metrics. (Note: Verified "Founders Club" deposit holders are grandfathered into full Gold Membership features for a locked-in rate of $99/month for life).
- Platinum Membership ($497/month): Provides unlimited manual Blasts, an extended 10-mile premium Blast Zone radius, and full access to Blast Buddy AI for automated scheduling, predictive claim analytics, "Radius Elasticity" optimization, and automated "Surge Bucket" execution.
3.3 Zero-Revenue-Share Guarantee
Local Blast is built to protect local business margins. We operate strictly on a flat-fee subscription basis. Local Blast LLC takes a 0% cut of your register sales. All transactions and redemptions occur physically at your counter, and you retain 100% of all customer revenue.
3.4 Cancellation and Refund Policies
- Subscription Cancellation: Merchants may cancel their active subscription at any time. All cancellations require a 30-day written notice submitted to billing@localblastapp.com.
- Prorated Refunds: For Merchants on pre-paid annual plans, a prorated refund for any fully unused calendar months remaining on the term will be calculated and returned, subject to the 30-day notice requirement. Monthly subscriptions are non-refundable for the active billing cycle.
4. THE BLAST PASS (VOUCHER) AND WALLET RULES
4.1 Claim Limits and Exclusivity
To prevent hoarding, promote fair play, and ensure high-intent traffic for our merchants:
- Consumer Wallet Cap: An individual user account may hold a maximum of three (3) active, unredeemed Blast Passes in their digital wallet at any single time. Users must redeem or delete an existing pass before claiming a fourth.
- Merchant Limit: Users may only hold one (1) active Blast Pass per individual business establishment at any given time.
4.2 Expiration and Countdown Logic
Every claimed Blast Pass is highly time-sensitive and includes an active, visible countdown timer (typically set to 24 hours, or a shorter custom window designated by the Merchant).
- Automatic Forfeiture: If a Blast Pass is not physically redeemed at the merchant counter prior to the expiration of the countdown timer, the pass is forfeited and automatically removed from the user's wallet.
4.3 Closed-Loop Inventory Reclamation
To protect Merchant inventory from "no-shows," the Platform utilizes a closed-loop reclamation model. The moment a claimed Blast Pass expires unredeemed:
- The specific inventory unit is instantly deactivated in the user’s wallet.
- The unit is automatically recycled and returned to the Merchant's active campaign inventory pool.
- The recycled unit becomes immediately eligible for redeployment in future Blasts, ensuring zero wasted promotional capacity.
5. THE BLAST COIN AND GAMIFIED ECONOMY
5.1 Nature of Blast Coins
Blast Coins are virtual in-platform tokens representing user engagement milestones. Blast Coins have no cash value, do not earn interest, cannot be purchased with or exchanged for real currency, are non-transferable, and do not constitute personal property. Blast Coins can only be used to unlock entertainment-focused Power-Ups and social messaging features within the Platform.
5.2 Earning Mechanics
Users earn Blast Coins by completing specific, active community tasks, including:
- Physical redemption of a Blast Pass at a verified Merchant counter.
- Active participation in local events, scavenger hunts, or social challenges.
- Completing in-app streak goals (e.g., engaging with the app five days in a row).
- Referring a local business to the Platform (earning a standard 50-coin referral reward, upgraded to a 500-coin bonus when the referred business places a reservation deposit).
5.3 Spending and Power-Ups
Blast Coins may be spent to enhance user interactions on the platform:
- Preset Messages (10 Coins): Sending a preset location broadcast (e.g., "Need a restaurant recommendation").
- Custom Messages (50 Coins): Unlocking the ability to broadcast a custom, 140-character local message.
- Radius Boost (100–200 Coins): Doubling the broadcast range of a user Blast from 1 mile to 2 miles.
- Double Time (50 Coins): Extending an active user chat window or Blast Pass duration.
5.4 "Claim Jail" Policy
To preserve the data integrity of our AI systems and protect our Merchants from bad actors, we enforce a strict behavioral credibility filter:
- If a user claims five (5) consecutive Blast Passes but allows all five to expire without physical redemption, their account is automatically placed in "Claim Jail."
- While in Claim Jail, the user's account is subject to a mandatory 24-hour freeze, during which they are completely blocked from claiming any new Blast Passes.
- Furthermore, the AI matching systems (Blast Buddy) will automatically exclude the engagement logs of accounts currently in Claim Jail to ensure optimization algorithms are trained only on high-intent consumer patterns.
6. EPHEMERAL COMMUNICATION AND CONTENT MODERATION
6.1 Ephemeral Chat Lifespans
User-to-user Community Blasts trigger location-restricted chat rooms for active users in the immediate radius. To keep the map fresh and focused on the present moment, all Community Blasts and their associated message logs automatically expire and are permanently deleted from our servers after two (2) hours.
6.2 Code of Conduct and Prohibited Content
Because Local Blast is built to cultivate safe, authentic offline communities, we maintain a zero-tolerance policy for toxic or harmful behavior. You are strictly prohibited from broadcasting any content that:
- Mentions, promotes, facilitates, or attempts to distribute illegal substances, narcotics, or counterfeit materials (including but not limited to references to prescription drugs, fentanyl, or illicit sales).
- Contains hate speech, racial slurs, harassment, threats, or abusive language targeting individuals or groups.
- Promotes graphic sexual acts, adult entertainment, or explicit nudity.
- Constitutes spam, fraudulent activity, or misleading business advertisements.
6.3 Adaptive AI Pre-Censoring and Moderation
To enforce these safety standards, the Platform utilizes a Proactive AI Content Filtering Module.
- Pre-Scan Protocol: All user-generated custom messages, names, and profiles are programmatically scanned prior to transmission.
- Adaptive Censor Engine: Our filter does not rely on static word lists; it employs adaptive natural language processing (NLP) to detect slang, alternate phonetic spellings, and creative spacing designed to bypass filters.
- Account Termination: Any attempt to broadcast prohibited content will result in the immediate blocking of the message, automatic forfeiture of all accumulated Blast Coins, and permanent termination of the user account.
7. PRIVACY, DATA SECURITY, AND LOCATION TELEMETRY
Our collection, storage, and processing of your data are governed by our Privacy Policy, which is incorporated by reference into these Terms.
- Location Tracking Disclosure: Because Local Blast is a hyper-local discovery tool, it requires continuous precise location telemetry (GPS coordinates) to operate. Your coordinates are used to determine which Blast Zones you are currently in and are never shared with third-party data brokers or external marketing networks.
- Anonymity Rules: To protect consumer privacy, users remain completely anonymous to Merchants. A Merchant is only notified that a "Blast Pass has been claimed" and cannot view individual user profiles or tracking logs unless the user chooses to present their Pass physically for in-store scanning.
- Data Deletion: Users may request the complete, permanent deletion of their account and all associated personal data at any time via the Help & Support menu in the App.
8. INTELLECTUAL PROPERTY AND PATENT PENDING STATUS
8.1 Proprietary Technology
All software, code, algorithms, visual interfaces, graphics, designs, databases, and proprietary terminology—including but not limited to "Local Blast," "Blast Buddy," "Blast Pass," "Blast Zone," "Blast Coins," "Claim Jail," "Opportunity Radar," and "Radius Elasticity"—are the sole and exclusive property of Local Blast LLC and are protected under copyright, trademark, and trade secret laws.
8.2 Patent-Pending Notice
Merchants and users acknowledge that the core logical workflows of the Platform—specifically our Dynamic Geofence Radius Elasticity logic, our Closed-Loop Campaign Inventory Reclamation system, our Real-Time Social Density matching systems, and our Automated Surge Blast mechanics—are subject to active utility patent applications filed with the United States Patent and Trademark Office (USPTO). Any unauthorized copying, reverse engineering, or commercial replication of these proprietary methods is strictly prohibited and will be prosecuted to the fullest extent of the law.
9. DISCLAIMERS AND LIMITATION OF LIABILITY
9.1 No Warranties
The Platform is provided on an "as-is" and "as-available" basis. We make no representations or warranties of any kind, express or implied, regarding the operation of the Platform, the accuracy of merchant listings, or the availability of specific Blast Passes.
9.2 Limitation of Liability
To the maximum extent permitted by law, Local Blast LLC, its managers, members, employees, and agents shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of your use of the Platform, including but not limited to failed deal redemptions, lost profits of merchants, user-to-user interactions, or temporary service interruptions.
10. GOVERNING LAW, JURISDICTION, AND DISPUTE RESOLUTION
10.1 Governing Law
These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of the State of Florida, without giving effect to any choice or conflict of law provision or rule.
10.2 Mandatory Mediation and Binding Arbitration
- Mediation: In the event of any dispute, controversy, or claim arising out of or relating to these Terms, the parties agree to first attempt to resolve the issue in good faith through non-binding mediation in Tampa, Florida.
- Arbitration: If mediation is unsuccessful within thirty (30) days of a written request to mediate, the dispute shall be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. The arbitration shall take place in Hillsborough County, Florida, before a single arbitrator.
- Waiver of Jury Trial: You and Local Blast LLC hereby expressly waive any constitutional or statutory right to a trial by jury or to participate in a class-action lawsuit.
- Litigation Costs: In any formal proceeding to enforce these Terms, the prevailing party shall be entitled to recover reasonable attorneys' fees, expert fees, and arbitration costs.
11. GENERAL PROVISIONS AND CONTACT INFORMATION
11.1 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be severed, and the remaining provisions shall continue in full force and effect.
11.2 Entire Agreement
These Terms, along with our Privacy Policy and any written Merchant Agreements, constitute the entire agreement between you and Local Blast LLC regarding your use of the Platform.

What information do we collect?

Identifiers: Name, email address, phone number, business name (for merchants), and account usernames.
Geolocation: General location (city, ZIP code) and, with permission, precise GPS location for delivering local offers.
Commercial Info: Vouchers claimed, redeemed, shared, or created; business transactions through Stripe.
Device Info: IP address, OS type, mobile identifiers, browser type, and crash logs.
Network Activity: Usage patterns, clicks, sessions, referral data, push notification responses.
Payment Info: Collected via Stripe for business subscriptions (we do not store payment card data).
Inferences: Preferences based on interaction history, for future personalization.
How We Collect It
We collect data from:
You: When you register, update your profile, interact with the app, or send/receive blasts.

Third Parties: Including Firebase, Google Maps, Stripe, OneSignal, Twilio, and GoHighLevel.
Social & Referral Networks: If you connect or refer friends via Facebook or invite contacts.

Local Blast is not intended for users under 18. We do not knowingly collect or allow minors to register or use the Service.
Third-Party Links & Services
This policy does not cover third-party platforms (e.g., Stripe, Google Maps) you may interact with via Local Blast. Please review their policies separately.
Local Blast is currently available only in the United States. If you are accessing the app from outside the U.S., you do so at your own risk.
California & GDPR-Specific Rights
CA residents may request disclosure of information shared with third parties.
You may opt out of the sale/share of personal information (even though we do not sell it).
GDPR users may contact us for access, correction, or deletion under applicable EU law.
